This Privacy Policy describes how remarQable LLC ("remarQable", "we", "us", or "our") handles information in connection with sparQ software and related services.

1. Overview

sparQ is a self-hosted business software platform. When you run sparQ on your own infrastructure, your business data stays on your servers — we do not access, collect, or store it.

This Privacy Policy covers:

• Information we collect when you interact with us directly (website, beta program, forum, support)
• Optional telemetry from self-hosted sparQ installations
• Data processed by optional sparQOne-hosted services

2. Information We Collect

2.1 Information You Provide

• Account information: Name, email address, and company name when you sign up for the Beta Program or forum.
• Communications: Messages, feedback, and bug reports you send us.
• Payment information: If you purchase services in the future, payment processing is handled by our third-party payment processor. We do not store credit card numbers.

2.2 Automatic Collection

• Website analytics: We use analytics tools to understand how visitors use gosparq.com. You can manage your cookie preferences at any time using the "Manage Cookies" link in the site footer.
• Telemetry (self-hosted): sparQ collects technical and operational telemetry as described in our End User License Agreement (Section 2). Core telemetry (installation data, EULA acceptance data, and company setup data) cannot be disabled. Health pings may be disabled by setting SPARQ_TELEMETRY_DISABLED=1. No business data is transmitted.

We also use Plausible Analytics, a privacy-focused analytics tool that does not use cookies or collect personal data.

2.3 Information We Do NOT Collect

When you self-host sparQ:

• We do not access your databases.
• We do not collect your customer, employee, or business data.
• We do not track your users or their activity.
• We do not read your documents, invoices, or communications.

3. How We Use Information

We use the information we collect to:

• Provide and maintain sparQ and related services
• Communicate with you about the Beta Program, updates, and support
• Improve sparQ based on aggregate, anonymized feedback and telemetry
• Comply with legal obligations

We do not sell your personal information. We do not use your data for advertising.

4. sparQOne Hosted Services

If you choose to use optional sparQOne-hosted services (such as SMS gateway, SMTP relay, payment processing, or resume parsing), those services will process data as necessary to provide the service. Specifically:

• SMS Gateway (sms.gosparq.com): Processes phone numbers and message content to deliver SMS messages on your behalf.
• SMTP Relay (smtp.gosparq.com): Processes email addresses and message content to deliver emails on your behalf.
• Payment Processing: Payment data is processed by our third-party payment processor (currently Stripe). We do not store full payment card details.
• Resume Parsing (parser.gosparq.com): Processes resume documents to extract structured data. Documents are processed in memory and not retained after parsing is complete.
• Backup Service: If enabled, encrypted backups of your data are stored in secure cloud storage. Backups are encrypted and accessible only to you.

Data processed by sparQOne services is used solely to provide the requested service and is not used for any other purpose.

5. Data Sharing

We do not sell or rent your personal information. We may share information only:

• With service providers who help us operate (e.g., cloud hosting, payment processing), bound by confidentiality obligations.
• When required by law, such as in response to a valid subpoena, court order, or government request.
• To protect rights and safety, if we believe disclosure is necessary to protect the rights, property, or safety of remarQable, our users, or the public.

6. Data Security

We implement reasonable technical and organizational measures to protect information under our control, including encryption in transit (TLS) and at rest where applicable. However, no method of transmission or storage is 100% secure.

7. Data Retention

• Account information is retained while your account is active and for a reasonable period thereafter.
• Telemetry data is retained for up to 3 years from the last active ping and is associated with a randomized Installation ID. To request deletion, email dev@remarqable.io with your Installation ID.
• sparQOne service data (SMS, email, parsing) is processed transiently and not retained beyond the time necessary to provide the service, except for logs retained for operational and debugging purposes for up to 30 days.

8. Your Rights

Depending on your jurisdiction, you may have the right to:

• Access the personal information we hold about you
• Correct inaccurate information
• Request deletion of your information
• Object to or restrict certain processing
• Data portability

9. Children

sparQ is not directed at children under 16. We do not knowingly collect personal information from children under 16. If we learn we have collected such information, we will delete it promptly.

10. International Users

sparQ is operated from the United States. If you access sparQ from outside the United States, you consent to the transfer of your information to the United States, which may have different data protection laws than your jurisdiction.

11. Changes to This Policy

We may update this Privacy Policy from time to time. Updated versions will be posted on this page and included with new releases of sparQ. Material changes will be communicated through the beta forum or email.
